Agency Procedure: MVR CHECK PROCEDURE

General Policy Statement:

The MVR (Motor Vehicle Record) Check procedure is based on typical risk management principles and practices established for vehicle operations. The basic structure has been developed by our insurance company and is intended to assure that Employment Link makes every effort to assure that corporate driving operation are responsible and safe. Further, this procedure is based on the MVR grading technique used by our insurance company to qualify company drivers as qualified and insurable. We are expected to follow the insurance company’s MVR grading recommendations.

 The following definitions apply to this procedure:

Accident - An accident is an event recorded on the MVR that results in bodily injury or significant property damage

Moving Violation - A moving violation is a violation recorded on the MVR that occurs as a result of action or inaction taken by the driver while the automobile is in motion

Termination/Reassignment - The program’s management reserves the right to terminate or reassign an employee consistent with MVR grading technique described within this procedure. Reassignment is reserved subject to the availability of a proper different job and the dictates of the circumstances and situations at that specific time, as determined solely by and at the discretion of management

Serious Violation - (as spelled out in our insurance company’s driver selection standards) A serious violation includes but is not limited to moving violations such as: driving while intoxicated or under and influence, driving without a license, leaving the scene of a hit and run, permitting an unlicensed individual to drive, reckless or careless driving, and any other violations that may be added by our insurance company and/or by the authorities in our State or Federal jurisdiction

Non-serious Vehicle Violation - All other moving traffic violations

1.1 All MVR’s will be evaluated twice each year and will be given a rating.

1.2 The rating is used to determine if the individual is qualified to drive for the company

1.3 MVR’s are rated according to the following categories:

1.4 In the event that the employee’s MVR receives a “probation” rating, the employee is to be placed on probation until their MVR improves to non-probationary rating with the passing of time. A disciplinary letter will be sent to the employee explaining this action with a copy going to the employee’s personnel file

1.5 In the event that the employee’s MVR receives a “Do not Drive” rating, the employee is to be prohibited from using any vehicle on company business. Management may immediately terminate or reassign an employee. The employee will be sent a disciplinary letter explaining management action with a copy going to the employee’s personnel file

1.6 Employees who believe they have been too severely disciplined or disciplined without good cause should utilize the company grievance procedure

2. Additional MVR Requirements

2.1 Agency vehicles may not be driven by anyone under the age of 21

2.2 Drivers between the ages of 21 and 25 will be considered so long as:
